I completely agree with this view. In a modern democratic society, a law that is cruel or treats people unequally cannot be considered a "true" law. For a state to be a "Rule of Law" state (Pravovoe gosudarstvo), its regulations must reflect the moral values of the people.
In Social Studies, we define a Rule of Law state as one where the law is supreme and everyone is equal before it. Such a state is built on the principle of protecting Human Rights . If a law is based on "equity" (fairness), it balances the interests of the individual and the state, preventing tyranny.
